Terms of Service
1. Who We Are
CyDuck ("CyDuck", "we", "us", "our") operates the website at cyduck.com and the Personal Cyber Score dashboard at dashboard.cyduck.com (collectively, the "Services").
For questions about these Terms, contact us at [email protected].
2. Eligibility
You must be at least 16 years old to use CyDuck. By using our Services, you confirm that you meet this requirement and that the information you provide is accurate. If you are using the Services on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
3. Description of Services
CyDuck provides:
- Free tools at cyduck.com — including email breach checking, password utilities, and AI spam analysis — available without an account.
- Personal Cyber Score dashboard at dashboard.cyduck.com — a sign-in-required service that monitors your email addresses, phone numbers, and social accounts for security risks and assigns you a personal security score.
The Services are provided for personal, informational, and non-commercial use. They are not a substitute for professional cybersecurity advice.
4. Accounts and Authentication
To use the dashboard, you must create an account using a valid email address or Google account via our authentication provider, Clerk. You are responsible for:
- Keeping your login credentials confidential.
- All activity that occurs under your account.
- Notifying us immediately at [email protected] if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.
5. Acceptable Use
You agree to use CyDuck only for lawful purposes and in accordance with these Terms. You must not:
- Use the Services to monitor email addresses, phone numbers, or accounts that you do not own or have explicit authorization to monitor.
- Attempt to circumvent, reverse-engineer, or interfere with any part of the Services.
- Use automated tools, bots, or scrapers to access the Services at scale.
- Upload, transmit, or distribute malicious code or content.
- Use the Services in any way that violates applicable laws, including data protection and privacy laws.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Violation of these rules may result in immediate termination of your account and, where appropriate, reporting to law enforcement.
6. Intellectual Property
All content, design, code, trademarks, and materials comprising the Services are the exclusive property of CyDuck or its licensors, protected under applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal use. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Services without our prior written permission.
7. Third-Party Services
CyDuck integrates with third-party services to deliver its functionality, including:
- Have I Been Pwned (HIBP) — for breach data lookups.
- Clerk — for authentication.
- Resend — for transactional emails.
- Anthropic — for AI-powered spam analysis.
- Google Analytics — for anonymized usage analytics.
Your use of these third-party services is subject to their respective terms and privacy policies. CyDuck is not responsible for the practices of any third-party providers.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
CyDuck does not warrant that:
- The Services will be uninterrupted, error-free, or secure.
- Breach data sourced from third parties (including HIBP) is complete, accurate, or up to date.
- Your Personal Cyber Score accurately reflects every aspect of your real-world security posture.
- The AI spam analysis tool will correctly identify all spam or phishing messages.
The Services are informational tools. They do not guarantee the security of your accounts or data.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYDUCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF CYDUCK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10. Indemnification
You agree to indemnify, defend, and hold harmless CyDuck and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.
11. Termination
You may stop using the Services and delete your account at any time by contacting us at [email protected].
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 8, 9, and 10.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will notify you by email or by displaying a prominent notice within the Services.
Your continued use of the Services after any change constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Services.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with applicable law. Where required by your local law (for example, within the European Union), mandatory consumer protection provisions of your country of residence apply and take precedence over any conflicting provision in these Terms.
For users in the European Union: nothing in these Terms affects your rights under applicable EU consumer protection legislation or your right to bring a claim before the courts of your country of residence.
We encourage you to contact us first at [email protected] to resolve any dispute informally before pursuing formal proceedings.
